Terms and Conditions 

These Terms and Conditions ("Terms") govern all purchases made through the online store operated by New Earth Group, including but not limited to products under the brands CellPower Actyva and Shots, by customers located in Hong Kong & Macao.

By placing an order through our website, you agree to be legally bound by these Terms.

2. Eligibility to Purchase

You must be at least 18 years old and reside in Hong Kong & Macao to place an order. By ordering, you confirm that you meet these conditions.

 


 

3. Order Process and Contract Formation

After placing your order, you will receive an email acknowledging receipt. This does not constitute acceptance.

A legally binding contract is formed only when you receive an order shipment confirmation.

We reserve the right to cancel or refuse orders at our discretion, including due to stock unavailability, suspected fraud, or errors in pricing or product descriptions.

 


 

4. Pricing and Payment

All prices are in HKD$, unless otherwise stated.

Shipping costs are clearly displayed at checkout before final confirmation.

We accept the following payment methods: PayPal, VISA, Mastercard, and AMEX.

We may update pricing at any time, but changes will not affect confirmed orders.

 


 

5. Delivery

New Earth Group currently ships to Hong Kong & Macao. Estimated delivery times are displayed during the checkout process and confirmed via the tracking link sent by email.

New Earth Group is not responsible for:

  • Orders shipped to incorrect addresses provided by the customer.

  • Lost or stolen packages that do not require a signature upon delivery.

In such cases, the customer assumes full responsibility.

If your order arrives damaged, you must notify us within 48 hours of delivery by using our customer support. Please include your order number and photos of the damaged product and packaging.

Please note: All orders are considered final and cannot be modified, cancelled, or exchanged.

 


 

6. Returns

We do not accept returns for any products purchased through our website.


 

7. Warranty and Complaints

Actyva purchased from New Earth Group comes with a 2-year limited warranty, effective from the purchase date. If required by local consumer law, the warranty period will be extended beyond two (2) years to meet legal obligations.

This warranty covers manufacturing defects and non-conformities that become apparent under normal and intended use of the product.

Exceptions

This warranty does not cover:

  • If the serial number of the product is unrecognizable, damaged, altered, or removed.

  • Damage resulting from non-compliance with the attached instruction manual, improper operation, or incorrect configuration.

  • Damage sustained during transportation to our repair center due to inadequate packaging.

  • Factors beyond the control of the product itself, such as unstable power supply, inconsistent voltage, or damage caused by force majeure events like fire, flood, earthquake, lightning, or storms.

  • Damage caused by using parts not authorized or approved by our company.

  • Damage caused by connecting accessories, other products, or peripheral equipment not authorized or approved by our company.

  • Damage resulting from disassembly, repair, attachment, or modification not authorized by our company.

  • Damage resulting from misuse, neglect, water exposure or improper handling.

  • Defects caused by wear and tear due to normal use or due to the normal aging of the product.

  • Cosmetic damage, including, but not limited to, scratches, dents, and broken material.

  • Consumable items (e.g. batteries, supplements, or perishable goods).

  • Products altered or repaired by unauthorized third parties.

  • If New Earth Group is informed by relevant public authorities or records that the product has been stolen.

  • If the user cannot in any way prove that they are an authorized user of the product (for example, through a proof of purchase). 

How to Report a Defect

If you believe your product is faulty or not as described, please contact our customer support providing:

  • Your order number + serial number

  • A clear description of the issue

  • Photos or videos, if applicable

We will evaluate your claim, and if a manufacturing defect is confirmed, we will offer a repair or replacement in accordance with your statutory rights.

 


 

8. Limitation of Liability

To the extent permitted by law, New Earth Group shall not be liable for indirect, incidental, or consequential damages arising out of the use or inability to use our products or website.

 


 

9. Privacy and Data Protection

Personal data collected during the order process will be handled in accordance with our Privacy Policy, which you can access on our website. 

 


 

10. Changes to These Terms

We reserve the right to amend these Terms at any time. Changes will not apply retroactively to confirmed orders. The most recent version is always available on our website.

 


 

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Hong Kong S.A.R.. Any disputes will be subject to the exclusive jurisdiction of the courts of the registered address of New Earth Group, without prejudice to mandatory consumer protection laws.
